Under this rule, parties must participate in mediation unless excused by the judge. However, mediation shall not be required in small claims actions under the Vermont Rules of Small Claims Procedure, in cases where parties have already engaged in mediation, foreclosure and evictioncases, actions to renew a judgment, and proceedings for a writ of habeas corpus or post-conviction relief. In every action in which mediation is required under this rule, parties must file a stipulation for mediation within 30 dyas of the last answer. If the parties fail to do so, the court may appoint a mediator and set a deadline for mediation. The fees and expenses of a mediator selected b the parties will be agreed upon by the parties and the mediator and each party must pay an equal share of the fees.
