This act authorizes the Utah Judicial Council "to establish rules to promote the use of ADR procedures by the courts ... as an alternative or supplement to court trial." It also creates the position of Dispute Resolution Program Director in the Administrative Office of the Courts, and authorizes the Office to contract with private ADR providers and organizations to provide services. The Dispute Resolution Program Director is responsible for the administration of court-annexed ADR programs in the state. The act also creates the Dispute Resolution Restricted Account. A portion of filing fees collected by the courts will be allocated in this account, which will be used to for court ADR programs.
The act lists the topics that must be covered by Judicial Council rules for ADR procedures, including the types of cases that may be referred to ADR and the qualifications that ADR providers must meet, among others. The act also provides minimum procedures for arbitration and mediation programs, as well as confidentiality protections for information disclosed during ADR proceedings.
