This study examines the evolution of the mediation program in the U.S. District Court for Nebraska from its inception in January 1995 to December 1998. This voluntary program refers cases either to private mediators or to a mediation center created under the State of Nebraska's Office of Dispute Resolution. Data from court records show that the settlement rate increased over time, as did the number of cases referred to private mediators (the settlement rates for the center and private mediators was roughly the same in 1998). Exit survey data showed that overall both parties and attorneys were very satisfied with the program, with most ratings between excellent and good. The variable given the lowest marks by both groups was the overall mediation process. In addition, attorneys reported saving on average 72.5 hours by mediating the case, while parties estimated a savings of $6,000 attorneys estimated a savings of $20,700.
