In child custody proceedings where there is an order of protection or domestic abuse is present, the court may order or refer parties to mediation. The victim of the alleged abuse must agree to mediation and is allowed a support person to attend the mediation. The mediation must be led by a certified mediator trained in domestic and family violence. In cases where child abuse or child sexual abuse is found, visitation by the perpetrating parent will be awarded only if under supervision, if the parent has received counseling or an intervention and if the child's address remains confidential. Overnight visits will not be allowed until the child's safety can be guaranteed.
