Supreme Court of Wyoming Civil Procedure Rule 40: Assignment of Cases for Trial or Alternative Dispute Resolution

Under this rule, the court may, either upon request of a party or on its own initiative, assign a case to undergo an alternative dispute resolution process, including settlement conference or mediation. Parties may also agree to submit to other forms of ADR. Parties may agree upon a neutral selection, though the court may make the selection if the parties cannot come to an agreement. The rule outlines procedures for conducting ADR processes and provides requirements regarding attendance at sessions, authority to settle, confidentiality, privilege, immunity, and the payment of fees and costs.
