The Arizona Supreme Court's Alternative Dispute Resolution Committee developed these "Standards" and "Guidelines" for Arizona courts interested in establishing mediation programs. The "Standards" serve as the mandatory program elements; whereas, the "Guidelines" serve as recommendations to be considered for court-connected mediation programs. The "Standards" address: the selection of cases and the courts' responsibility of informing the parties involved, attendance as mandatory, and confidentiality. The "Guidelines" address: accessibility to mediation; the court's responsibility regarding the program; the information the court should provide judicial officers, court personnel, and users; the timing of referral; mediator qualifications; and the evaluation of programs. The Appendix includes: Common Questions About Mediation, the letter of referral, the Confidentiality Agreement, and Rule 12-2238 ("Mediation; privileged communications; exceptions; liability; definition").
