Recommendations for Supreme Court Rules on Mediation

The Illinois Supreme Court's Study Committee on Mediation of Child Custody, Support, and Visitation Disputes proposes these rules for family mediation programs in Illinois and provides commentary in an effort to support and promote the use of mediation in the state. They address: authorization of mediation, mandatory mediation of certain cases, appointment and qualification of mediators, mediator responsibilities, applying safeguards in cases of impairment, confidentiality and privilege, intake and screening, family service officers, termination of mediation generally and on motion of a party, entry of judgment or order, personal safety protocols, compensation, reporting to the court and recordkeeping, circuit court advisory committee, and two appendices consisting of the bibliography of resources that were used to develop these recommendations and individuals that made presentations to the committee who were not members of the committee.
