For divorce cases that involve property, separate maintenance or custody disputes, this section allows the court to refer parties to mediation as long as there are no allegations of domestic violence or child abuse. This exception can be overruled, however, if the mediator has training concerning the effects of domestic violence or child abuse, the alleged victim is capable of negotiating with the other party, and the mediation process includes provisions to protect against an imbalance of power between the parties.
