For cases involving custody or visitation disputes, this statute instructs the court to refer the parties to mediation. Exceptions to this mandatory referral include cases where a party can show an undue hardship, where domestic violence or drug abuse is involved, or where the parties have agreed to voluntary mediation, subject to court approval. The statute also stipulates that agreements reached in mediation are binding, and establishes confidentiality for all communications made during the mediation proceedings.
