These are the statewide rules for the New York Supreme Court Commercial Division. Rules 3, 10, and 11 of these rules address alternative dispute resolution.
Rule 3 states that during any stage of a commercial proceeding, the court may appoint an uncompensated mediator to resolve all or some of the issues in a party's case. Additionally, this rule permits a party's counsel to proceed with a settlement conference before a justice other than the justice assigned to the case.
Under Rule 10 at a preliminary conference an attorney must submit to the court a form that certifieds they discussed the availability of ADR with their clients.
Finally, Rule 11 when a court issues a preliminary conference order the order shall contain directions on how to submit a case to the alternative dispute resolution program.
