This statute permits the court to refer child custody disputes to mediation. Cases in which domestic violence or child abuse has occurred will be exempt from mediation, unless the alleged victim requests mediation, or the following three conditions are satisfied: the mediator has training in domestic violence or child abuse cases; the alleged victim is capable of negotiating with the other party without negative effects; and the mediation process contains provisions to protect against an imbalance of power between the parties.
