This article explains a study of the Winnebago County pilot mediation program, which utilized a computerized mediation evaluation system to track statistical data. The pilot program, the mediation process and typical mediator styles are explained in full. Statistical data regarding settlement rates showed that the program has become more successful in reaching agreements as time has gone on. The study found that whether or not a case reaches a settlement frequently depends on the issues involved, the length of time that the case has been in court, the skill or experience of the mediator and other factors. A noted additional value of mediation is its potential impact on future settlements outside of the mediation. The study demonstrated that mediation was more cost- and time-effective than adjudication.
