In contested divorce, custody or visitation disputes where there is evidence of spousal abuse or a protective order is in effect, this statute prohibits the court from requiring parties to participate in mediation. The statute also requires mediators to screen for the occurrence of violence between family members before beginning the mediation process. Mediation may only take place in cases involving domestic violence when it is agreed to by the victim of the violence, the mediation is provided in a manner that protects the safety of the victim, and a support person is allowed to accompany the victim to the mediation.
