Hawaii Circuit Courts Rule 12.2 - Alternative Dispute Resolution

The court is authorized to order parties to participate in alternative dispute resolution, either at its own volition or at the request of the parties. ADR processes may include mediation, summary jury trial, neutral evaluation, non-binding arbitration, presentation to a focus group, or "other such process the court determines may be helpful in encouraging an economic and fair resolution of all or any part of the disputes presented in the matter." The rule lists factors the court should consider before ordering a case to ADR, and addresses neutral fees, selection of a neutral, discovery, attendance requirements, and communication among ADR participants.
