This rule outlines that all trial and appellate courts have the authority to encourage the settlement of controversies with appropriate ADR. Circuit and appellate courts are permited to order any civil, juvenile, probate, or domestic relations case to mediation. Parties ordered to mediation may select a mediator fromt he Commission's roster of approved mediators or move to dispense the order to mediate for good cause (i.e. not being able to pay the cost of mediation).
