Alaska Rules of Probate Procedure 4.5 - Mediation and Other Forms of Alternative Dispute Resolution

Under this rule, the court may order mediation in any action on its own motion, or in response to a motion from an interested person, so long as it determines that mediation may result in an equitable settlement. The rule outlines requirements for what must be included in the order of mediation, as well as procedures for conferences and the use of mediation briefs. The rule specifies the authority of mediators, sets confidentiality requirements, and outlines procedures for termination and stipulation. Brief mention is made of other ADR processes.
